These terms and conditions and legal information (hereinafter, “Terms and Conditions”) govern the use of and access to the website www.doqia.es and the digital platform “Doqia” (hereinafter, referred to interchangeably or together as the “Website” or the “Platform”), owned by Doqia S.L (hereinafter, indistinctly, “Doqia” or the “Controller”). Doqia informs Users that it complies with current data protection regulations, and in particular, with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation), as well as with the Information Society Services and E-Commerce Act, Law 34/2002, of July 11.

Registering, accessing, and browsing the Platform implies full and unreserved acceptance of these Terms and Conditions by the visitors and Users of the Website.

1. PURPOSE

The purpose of these Terms and Conditions is to regulate the terms and conditions applicable to the provision of services to registered users (hereinafter, “Users”). These conditions include our Privacy Policy, accessible from the footer of the Website or the Platform.

The services offered by Doqia on the Platform consist of providing a software or modular solution that facilitates access and management of office workspaces in order to create a hybrid work environment.

2. USER SIGN-UP, REGISTRATION, AND PROFILE

To become a User of the Platform, the following requirements must be met:

The User guarantees that all identity data provided to Doqia during the sign-up process on the Platform is truthful, accurate, and complete. The User also agrees to keep this data updated. Should the User provide any false, inaccurate, or incomplete data, or if Doqia has well-founded reasons to doubt its truthfulness, accuracy, or completeness, Doqia may deny present or future access to and use of the Platform or any of its contents and/or services, and may also remove the User and cancel their account.

The User agrees not to disclose their password or make it accessible to third parties. Since Doqia cannot guarantee the identity of registered users, the User will be solely responsible in the event of password use by third parties, including any statements made via the Platform, or any other actions carried out by using the password.

Users must immediately inform Doqia in the event of the theft, disclosure, or loss of the password, by notifying Doqia via email catalina@doqia.app

Once the sign-up process is complete, Doqia will enable and grant access to the Platform.

3. USERS AND CONTRACT TERMINATION (ACCOUNT DELETION)

The User may at any time contact Doqia to request the deletion of their profile from the platform. In any event, the User may revoke their consent at any time by sending an email from their registered email address with the subject “User Cancellation” to catalina@doqia.app inserting in the body of the email the username, email address, mobile phone number, and NIF used to register on the Platform.

Doqia may suspend or deregister a User (and therefore choose to suspend or terminate the contractual relationship) immediately if any obligation under the Terms and Conditions is breached. In such a case, Doqia will cease providing the services offered through the Platform without needing to cite any reason.

4. USER OBLIGATIONS

Users are solely responsible for accessing and correctly using their profile and the Platform’s functionalities, in accordance with applicable national or international law, as well as the principles of good faith, morality, good customs, and public order. Specifically, but not limited to, they agree to diligently comply with these Terms and Conditions.

Users shall refrain from using their profile for purposes or effects other than (a) using the contracted Doqia functionalities; (b) viewing the offers available on the Website or the Platform; or (c) acquiring the services offered by Doqia. Likewise, it is forbidden to use the Platform in any way that hinders or impedes the Platform’s functionality or the normal use or enjoyment by other Users.

In particular, and by way of example but not limitation, Users agree to:

Likewise, any user who is categorized as a “Professional,” as defined in Clause 5.1, undertakes to be registered with the relevant professional college or similar organization required to perform the commissioned services for as long as they remain an active user on the Platform. They also agree to have professional liability insurance.

Those who fail to meet these obligations will be liable for any harm or damage they cause. Doqia will not be held responsible for any consequence, harm, or damage that may result from such illicit access or use by third parties. Doqia may deny access to the Platform to any Users who fail to meet these obligations.

Likewise, any User must comply with the corresponding tax obligations. To that end, the Platform may periodically provide data or relevant information so that the User can meet these obligations.

5. USER SIGN-UP AND SERVICES

Once registration is completed, the User will be able to access the Services detailed in section 5.2.

5.1. User Sign-Up.

In order to be part of the Doqia platform, the sign-up form must be completed. Currently, there are two types of users in Doqia:

1. Registration: The patient registers on the platform by entering their email address and creating a password.
2. Start of Use: Once the account is created, the patient can start exploring and requesting available services.

● Process for professionals:
1. Registration and application: The professional registers on the platform by entering their email address and creating a password. In addition, the professional must apply by filling out a form with the following information:

2. Application review: The Doqia team reviews the application and sends a response by email. If accepted, the professional can access their enabled account.

4. Profile activation: Once the profile is complete, it will be public, and the professional can begin serving patients through the platform.

5.2 Services available on the Doqia platform:

Currently, Doqia offers the following solutions through the Platform:

5.3 Cost of Services

The Professional will receive a fixed amount for the provision of their services and a variable amount depending on the distance to the Patient’s home.

The fees related to the provision of services can be freely determined by the user, although Doqia may suggest a scale or range of amounts. However, the variable amount related to the distance the Professional must travel to the Patient’s home will be automatically calculated by Doqia based on the actual distance traveled.

5.4. Requesting services

When a User registered as a Patient needs a service, they can access the platform and choose the service they wish to hire. Once they have accessed it, they must set the address where they want to receive the service so that the available Professionals are displayed.

The Patient may choose among the Professionals available in their area by accessing their profiles. The Patient is free to select the professional they consider appropriate, and Doqia holds no responsibility for that choice.

Once the Patient has selected the service characteristics, they will proceed to book it. From that moment, the Professional has 24 hours to accept the booking request, making the contractual relationship established through the Platform binding. Users will be obligated both to perform the service and to pay the agreed fee for that service, with Doqia being exempt from liability.

For Professionals who choose to use the Platform, their relationship with Doqia will be limited to that of an independent third-party contractor and not that of an employee, agent, co-member, etc.

5.5. Payment of fees

The Patient will be responsible for paying for the contracted services at the time the service order is placed. This payment will be held by the payment provider or processor selected by Doqia until the service is confirmed.

In the event that the Professional does not attend the appointment and does not provide the service, Doqia will cancel the service order and refund the amount paid by the Patient.

5.6. Claims for unsatisfactory services

Patients may file a claim regarding a service if they are not satisfied with the Professional’s work. They have a 24-hour period from the end of the service to file the claim through the app. Doqia’s team will review the case and decide whether to refund the amount paid to the Patient or to release the funds to the Professional’s account.

If the Professional does not show up, the Patient must contact the Platform to seek a solution. Otherwise, and provided the Patient notifies it within 24 hours, Doqia will refund the full amount paid by the Patient.

6. PERSONAL DATA PROTECTION

To access information regarding personal data protection, please see our Privacy Policy. You must expressly accept and consent to the sending of commercial communications at the time of registering as a user.

7. INTELLECTUAL PROPERTY

Doqia owns or licenses all intellectual and industrial property rights included in the Platform, as well as any content accessible through it. The authorization given to the User to access and use the Platform and the services offered does not imply any transfer of intellectual or industrial property rights over it.

8. TAXES

The Professional who provides the services is responsible for complying with the applicable tax legislation in force at any given time. Tax regulations may require Doqia to collect certain tax information from our Professionals.

9. ARTIFICIAL INTELLIGENCE

Doqia will at all times comply with the provisions of the Artificial Intelligence (AI) Regulation. It states that any AI systems that may be used are safe and respect user rights, having carried out prior impact assessments.

10. LINKS

On the Platform, the User may find links to other websites operated by third parties. This does not imply any relationship, collaboration, or dependency with Doqia. It does not entail any guarantee whatsoever.

11. SEVERABILITY OF CLAUSES

If any of the clauses of these Terms and Conditions is found to be null and void, it shall be deemed not to have been included. Such declaration of nullity shall not invalidate the remainder of the Terms and Conditions.

12. UPDATE AND MODIFICATION OF THE WEBSITE OR PLATFORM

Doqia reserves the right to modify, at any time and without prior notice, the structure and design of the Website or Platform, as well as these Terms and Conditions and the Privacy Policy. An updated version of these Terms and Conditions will be permanently available on the Platform.

13. APPLICABLE LAW

The validity, enforcement, and interpretation of these Terms and Conditions will be governed by Spanish law. They are subject to the Courts and Tribunals of Barcelona.

14. UPDATE OF THE TERMS AND CONDITIONS

Doqia reserves the right to modify these Terms and Conditions to adapt them to legislative or judicial developments. In any case, any modification of these Terms and Conditions will be notified to Users.
